If you're a landlord or tenant in New Zealand, keeping up with tenancy law changes can feel like a full-time job. With the latest amendments to the Residential Tenancies Act (RTA), including new rules around tenancy termination and the introduction of pet bonds, it’s essential to stay informed. These updates, rolling out in 2025, aim to create a fairer, more transparent rental market for everyone.

So, what do these changes mean for you? Let’s break them down.

Changes to Tenancy Termination Rules

Effective from 30 January 2025, the amendments have adjusted the notice periods and conditions under which tenancies can be terminated:​

Periodic Tenancies:

  1. Landlords can now terminate a periodic tenancy without providing a specific reason by giving a no reason 90 days' notice. Additionally, a 42-day notice can be given if:​
    1. The owner or their family member requires the property as their principal residence within 90 days of the tenancy ending and intends to reside there for at least 90 days.​
    2. An unconditional agreement for the sale of the property requires vacant possession.
    3. The property is needed for occupation by employees or contractors of the landlord, provided this use is customary and stated in the current tenancy agreement.​
  2. Tenants can terminate a periodic tenancy by providing 21 days' notice.

It's important to note that landlords are prohibited from issuing termination notices in retaliation against tenants exercising their legal rights. Such retaliatory notices can be challenged and deemed unlawful by the Tenancy Tribunal.

Fixed-Term Tenancies:

  1. Either party must give notice to end a fixed-term tenancy between 90 and 21 days before the term concludes. No specific reason is required for this notice.
  2. Alternatively, both parties can mutually agree on a different arrangement. For fixed-term tenancies that started on or after 11 February 2021 and expire on or before 30 April 2025, the previous law applies. For those expiring on or after 1 May 2025, the new provisions will be in effect.

Pet Bonds & New Rules (Effective Late 2025)

  1. Pet Bonds: Landlords can require a pet bond of up to two weeks' rent, in addition to the standard bond, to cover potential pet-related damage.
  2. Tenant Responsibilities: Tenants are fully liable for any pet-related damage beyond fair wear and tear.
  3. Compliance Measures: New rules introduce penalties for breaches related to pet consent and bond requirements.
